Addendum Regarding Rental Flood Disclosure TXR 2015

Writer's picture: PenFed Realty TexasPenFed Realty Texas

A new TXR form has been released regarding the landlord's disclosure of flooding in a rental property. The form is required if the landlord is aware that the property is in a 100 year flood plain or has flooded in the last five years. It is prudent to provide the form if the landlord has no knowledge as well. Landlords should complete the form without assistance from the agent. The form should be presented at or before the initial signing of the lease. It should only be presented on the renewal of a lease if it was not presented when the lease originated. This form does not apply to the seller's temporary lease.

The form is attached below and becomes mandatory on January 1, 2022.
