Berkshire Hathaway HomeServices agrees to comprehensive nationwide settlement

I am writing to inform you that Berkshire Hathaway HomeServices announced this morning they have reached a nationwide settlement in the ongoing class-action Sitzer-Burnett and Moehrl litigation cases.


While the settlement remains subject to court approval, HomeServices of America CEO Gino Blefari stated that this settlement was reached in order to “safeguard agents, employees, companies and franchisees” and extends to all of HomeServices companies, agents and franchisees.


The settlement involves a significant financial commitment from HomeServices made on behalf of its companies, affiliated agents and franchisees. PenFed Realty is including in our communication several key resources that we encourage you to fully review:

Despite HomeServices’ confidence in the strength of its appeal, the decision to settle was taken with the long-term welfare of its franchisees, agents and employees in mind. With the prospect of a protracted and uncertain appellate process and the sheer number of copycat cases that have been filed, HomeServices believed this was the appropriate and correct decision. As part of the settlement, HomeServices expressly denies engaging in any of the activities alleged in the various lawsuits.

 

We will continue to provide ongoing updates as we move through the formal court and settlement approval process. We extend our deepest gratitude to each of you for your unwavering commitment and resilience during this challenging period. Your dedication and contributions have been pivotal to our company's strength and will continue to be invaluable as we navigate forward together.
